Terms of Service

LaxTrax is an AI-powered athletic performance tracking application that uses camera-based computer vision and artificial intelligence to analyze lacrosse training sessions. The Service captures and processes video of training activities to generate performance metrics, insights, and recommendations.

You must be at least 13 years of age to use LaxTrax. If you are between 13 and 18 years of age, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By allowing a minor to use the Service, the parent or guardian agrees to supervise the minor's use and accepts full responsibility for the minor's activity.

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration, including your name, email address, and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

By using LaxTrax, you acknowledge and consent to the collection of the following information:

• Personal information: name, email address, phone number
• Usage data: training sessions, repetitions, performance metrics
• Device information: device type, operating system
• General location data: city and state level only
• Team affiliation and role information

You further consent to receiving marketing emails and SMS messages from LaxTrax. You may opt out of marketing communications at any time by following the unsubscribe instructions in any message or by contacting us at support@lax-trax.com. Opting out of marketing communications does not affect transactional messages related to your account or the Service.

Videos and recordings captured during training sessions ("User Content") remain your property. However, by using the Service, you grant LaxTrax a non-exclusive, worldwide, royalty-free license to use, process, and analyze your User Content solely for the purpose of providing the Service and generating your performance data.

You further grant LaxTrax a perpetual, irrevocable, royalty-free license to use anonymized and aggregated training data derived from your sessions for the purpose of improving our AI models, algorithms, and the overall Service. This anonymized data will not be personally identifiable and will be combined with data from other users to enhance the accuracy and performance of our technology.

If you create a Coach account, you are responsible for managing and overseeing the data of all team members associated with your account. You represent and warrant that you have obtained all necessary consents from team members (and their parents or guardians, where applicable) for the collection and processing of their data through the Service. You agree to indemnify AlbrightForge LLC against any claims arising from your failure to obtain such consents.

Certain features of LaxTrax require a paid subscription. By subscribing, you agree to the following:

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will continue to have access to paid features until that date.
• Refund Policy: No refunds will be issued for the current billing period. If you cancel, you will not be charged for subsequent periods, but no partial or prorated refunds will be provided for unused time within an active billing cycle.

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or disassemble any portion of the Service; (c) interfere with or disrupt the integrity or performance of the Service; (d) upload malicious code or content; (e) impersonate another person or entity; or (f) use the Service to collect data about other users without their consent.

All rights, title, and interest in and to the Service, including but not limited to the AI models, algorithms, software, design, graphics, and trademarks, are and shall remain the exclusive property of AlbrightForge LLC. Nothing in these Terms grants you any right to use the LaxTrax name, logo, or branding without prior written consent.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALBRIGHTFORGE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (D) INACCURACIES IN AI-GENERATED PERFORMANCE DATA OR RECOMMENDATIONS.

IN NO EVENT SHALL ALBRIGHTFORGE LLC'S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO LAXTRAX IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless AlbrightForge LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your User Content.

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALBRIGHTFORGE LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. AI-GENERATED INSIGHTS AND PERFORMANCE METRICS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS MEDICAL OR PROFESSIONAL ATHLETIC ADVICE.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the State of Florida, and you hereby consent to the personal jurisdiction and venue of such courts.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice within the Service. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
